[MEE] JUL. 17 – Civil: Motion to dismiss for insufficient service of process, choice of law

1. Motion to dismiss for insufficient service of process는 original motion to dismiss에 포함되지 않으면 waiver로 간주 되지만, (1) 수정 시 반대 당사자가 prejudice를 갖지 않았고 (2) 기소나 사건 결정에 delay가 없다면 Amendment가 받아 드려질 수 있다. 2. Service of Process는 individual’s dwelling or usual place of abode에 suitable age and discretion who resides there인 사람에게 전달 되어야만 한다. 3.
